These terms apply when you use DannyBarford.com or buy downloadable fitness programmes from the store. Please read them before ordering.

1. The trader and contact details

DannyBarford.com is operated by a UK-based sole trader trading as DannyBarford.com.

DannyBarford.com is not currently registered for VAT.

2. Using the website

You may use the website only for lawful personal purposes. You must not interfere with the site, attempt unauthorised access, introduce malicious code, scrape protected content or use the site in a way that infringes another person’s rights.

You must be at least 18 to purchase independently. If you are under 18, a parent or guardian must review and place the order for you and supervise appropriate use of the programme.

3. The products

The store supplies digital fitness programmes and related downloadable content. Product descriptions explain the principal features, format and price. Images and previews are illustrative, but we take reasonable care to ensure descriptions are accurate.

You are responsible for checking that you have a suitable device, software and internet connection to access PDF files, links, videos or other stated formats.

4. Orders and the contract

By submitting an order, you offer to buy the selected product under these terms. You can correct order errors before payment. A contract is formed when we accept the order and send confirmation or make the purchased digital content available, whichever occurs first.

We may reject or cancel an order before acceptance where a product or price is clearly incorrect, payment is not authorised, fraud is suspected or the order cannot lawfully be fulfilled. If payment has been taken for a rejected order, it will be refunded.

Please check your email address carefully because order confirmations and download access may be sent to it.

5. Prices and payment

Prices are shown in pounds sterling unless stated otherwise. DannyBarford.com is not currently VAT registered. Payment is processed securely by Stripe. Stripe may apply its own terms and privacy notice to payment processing.

You must have authority to use the selected payment method. Access may be withheld if payment fails, is reversed or is reasonably suspected to be unauthorised.

6. Immediate digital downloads and cancellation

Important: express consent and loss of the 14-day cancellation right

Before receiving immediate access, you will be asked to expressly agree that supply of the digital content may begin during the normal 14-day cancellation period and to acknowledge that your right to cancel will be lost once downloading, streaming or other supply begins.

By actively giving that consent and acknowledgement and then accessing the content, you request immediate performance and understand that you lose the statutory 14-day right to cancel for that digital content.

If you do not provide the required express consent and acknowledgement, immediate digital access should not begin during the cancellation period.

The loss of the cancellation right does not affect your statutory remedies where digital content is faulty, misdescribed or not supplied with reasonable care and skill. Contact us promptly at hello@dannybarford.com if there is a problem.

Where a refund is legally due, it will normally be returned to the original payment method. Nothing in these terms limits rights that cannot lawfully be excluded.

7. Delivery and access

Digital content is normally made available after successful payment through an order page, account area, email link or other method described at checkout. Delivery times may be affected by payment checks, system maintenance or events outside reasonable control.

You should download and securely retain any permitted files and order confirmation. Tell us promptly if access details fail. We may provide replacement access after reasonable verification of the order.

8. Personal-use licence and intellectual property

On payment, you receive a limited, personal, non-exclusive, non-transferable licence to use the purchased content for your own private training. Ownership and intellectual-property rights remain with DannyBarford.com or the relevant rights holder.

You must not copy for others, share login or download links, upload files publicly, resell, sublicense, distribute, adapt for commercial use or remove copyright notices. Reasonable personal backup copies are permitted where technically available.

9. Health and fitness notice

Training involves risk

The programmes provide general fitness information and are not medical advice, diagnosis, treatment or a personalised assessment. Results vary and no particular result is guaranteed.

Consider obtaining medical or appropriately qualified professional advice before beginning, particularly if you have an injury, medical condition, are pregnant, take medication, have been inactive or are unsure whether exercise is suitable. Stop and seek appropriate help if you experience pain, dizziness, faintness, chest discomfort or unusual symptoms.

You are responsible for selecting appropriate loads, using suitable equipment, maintaining safe technique and training within your abilities. Where appropriate, use a qualified coach or spotter and follow gym and equipment instructions.

10. Customer responsibilities

You must provide accurate information, keep account and download credentials secure, use the content lawfully and notify us promptly of suspected unauthorised access. You are responsible for evaluating whether the programme is suitable for your circumstances.

11. Our responsibility

We do not exclude or limit liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, for business losses where you purchase as a consumer, or for failures caused by events outside reasonable control, subject always to rights that cannot legally be limited.

Nothing in these terms makes you responsible for injury or loss caused by our negligence or defective digital content where the law provides otherwise.

12. Privacy, changes and availability

Personal information is handled in accordance with our .

We may update the website, products and these terms. Changes will not retrospectively remove rights under an existing contract. We may suspend site access for security, maintenance or legal reasons and will use reasonable efforts to minimise disruption.

13. Governing law and disputes

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you retain any mandatory protections and may usually bring proceedings in the courts of the part of the UK where you live. Please contact us first so we can try to resolve any concern informally.

If any provision is found invalid, the remainder will continue. A delay in enforcing a right does not waive it. No person other than you and DannyBarford.com has a right to enforce the contract unless the law says otherwise.
